UNCONTESTED DIVORCE IN MARYLAND

The simplest and least expensive way to obtain a divorce in Maryland is if you and your spouse agree on the resolution of the issues incident to the end of your marriage and agree to proceed with your divorce on an “uncontested” basis. An uncontested divorce is one in which all the issues have been resolved by the parties and there is nothing for the Court to do except issue a judgment of absolute divorce.

If you and your spouse have agreed on how you are going to divide up your marital property and have reached agreement on the issues of child custody, support and alimony, then you are a good candidate for an uncontested divorce.

If you want an uncontested divorce, you can proceed with or without a separation agreement. If there is no property to be divided, you have no children, and your divorce is fairly simple and straight forward, you can file for divorce without a separation agreement. If, however, you are dividing up property, and/or are resolving issues regarding children or alimony, we recommend that you prepare a separation agreement. This agreement will be incorporated into the Court’s judgment of absolute divorce and will be binding upon you and your spouse after the divorce. It will clearly set forth the rights and obligations of each party.

In uncontested divorce matters, we regularly prepare separation agreements for our clients. Our clients will advise us of the terms of the agreement they have reached with their spouse and we incorporate those terms in a valid and binding legal agreement, while providing guidance and ideas on the agreed upon terms and their implementation. Frequently, we are retained by clients to review agreements prepared by their spouse’s attorney. In these cases, we provide counsel and advice regarding the agreement and its terms.

We charge a flat fee of $1,500 to represent clients in uncontested divorce proceedings, which fee includes either the drafting or review of a separation agreement, if applicable, and representation through the divorce process. Court filing fees of $105.00 and service of process costs are additional, if applicable.
